This webinar will cover the fundamentals of defending a tax position. Specifically, this paper and webinar session will address the following questions:
  • Background to ATO investigations;
  • What are the stages of defending a tax position, including a discussion of the following administrative processes:
    • ATO reviews;
    • ATO audits;
    • ATO objections; and
    • Challenging an unfavourable objection in the AAT or Federal Court.
  • On what basis can a taxpayer defend their tax position?
  • What is the importance of the onus of proof in a tax case?
  • What can you do if you think an ATO representative is being unreasonable?
  • When does a matter proceed to the AAT or Federal Court? What is the difference between the AAT and the Federal Court?
